Kuni Terms of Service

Effective July 3, 2026.

These Terms of Service are an agreement between you and Kuni for use of the Kuni website, SMS/iMessage accountability coach, AI coaching experience, trackers, optional connector features, billing flows, and related support channels. By using Kuni, texting the Kuni number, connecting an account, or buying a subscription, you agree to these Terms and the Privacy Policy.

1. Eligibility

You must be at least 18 years old and legally able to enter into these Terms. You may use Kuni only for your own personal accountability, planning, wellness, productivity, and habit-support purposes, unless Kuni separately approves another use in writing.

2. What Kuni Does

Kuni is an AI accountability coach that you can text. It can respond to messages, send proactive check-ins, remember goals and commitments, track workouts and meals, review supported media that you send, maintain private tracker pages, and use optional read-only connectors such as Google Calendar, Gmail, and Outlook when you choose to connect them. Kuni is not an emergency service and is not a substitute for professional advice.

3. Account, Phone Number, and Connectors

Your access may be tied to the phone number you use with Kuni. You are responsible for making sure your phone number and contact details are accurate and that you are authorized to use them. If you connect Calendar, Gmail, Outlook, or another supported account, you authorize Kuni to use that connection only for the feature scope presented during connection. Current Google Calendar, Gmail, and Outlook connector features are designed for read-only use inside Kuni; they do not let Kuni send email, delete email, edit calendars, or create calendar events unless a future feature clearly asks for separate permission.

4. SMS, iMessage, and Mobile Message Consent

By providing your phone number, texting Kuni, signing up, or otherwise asking to use the Service by message, you consent to receive automated, recurring, and proactive SMS, iMessage, MMS, and related mobile messages from Kuni and its messaging providers. Messages may include onboarding, coaching replies, reminders, check-ins, tracker links, billing or account notices, opt-in or opt-out confirmations, and support replies. Message frequency varies based on your goals, settings, and use of the Service. Message and data rates may apply. Consent to mobile messages is not required as a condition of buying any product or service.

You can opt out of Kuni mobile messages by replying STOP, CANCEL, END, QUIT, UNSUBSCRIBE, or any other clear request to stop receiving messages. You can reply HELP for support information. Opting out of mobile messages may prevent Kuni from providing core text-based features. SMS or iMessage opt-out does not automatically cancel a paid subscription.

5. Billing, Trials, Renewal, and Cancellation

Paid plans, trials, prices, billing intervals, renewal terms, cancellation paths, refund statements, and taxes are shown at checkout and in subscription or receipt emails. Checkout may offer a free trial before paid renewal. Unless checkout says otherwise, subscriptions renew until cancelled. Stripe processes payment details; Kuni does not store full card numbers. Deleting a text thread, blocking a number, disconnecting a connector, or replying STOP does not cancel a paid subscription. You are responsible for cancelling through the checkout, billing, or support path provided for your subscription.

Except where required by law or stated at checkout, fees are non-refundable once charged. If you believe you were charged in error, contact hello@textkuni.ai.

6. User Content

You may send or create messages, photos, screenshots, voice notes, meal details, nutrition targets, workout logs, goals, calendar-related instructions, and other content through Kuni ("User Content"). You keep your rights in your User Content. You give Kuni a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, process, analyze, display, and create operational summaries of User Content as needed to operate, personalize, secure, support, bill for, and improve the Service and to comply with law.

7. AI Outputs and Personal Responsibility

Kuni uses AI systems, so outputs may be inaccurate, incomplete, delayed, outdated, or not appropriate for your situation. You are responsible for reviewing outputs before relying on them. Do not use Kuni for emergency, medical, mental-health, nutrition, fitness, legal, tax, financial, investment, safety-critical, or other regulated decisions.

8. Wellness and Safety Limits

Kuni is for accountability, habit support, and general wellness information. It is not medical, nutrition, fitness, mental-health, therapy, legal, financial, tax, or other professional advice. Consult qualified professionals before making health, nutrition, exercise, medical, mental-health, financial, tax, or legal decisions. Exercise and diet changes can involve injury or health risks; stop if something feels unsafe and seek professional care when appropriate.

If you are experiencing an emergency, crisis, or immediate risk of harm, contact your local emergency number or 911. If you have or may have an eating disorder, do not rely on Kuni nutrition or meal features; seek help from a qualified clinician or a local eating-disorder support organization.

9. Acceptable Use

You agree not to:

• use Kuni for unlawful, deceptive, abusive, harassing, or harmful purposes;
• send content you do not have the right to send, including another person's sensitive information without permission;
• send payment card numbers, government ID numbers, passwords, secrets, or highly sensitive legal, tax, payroll, or medical records;
• use Kuni to spam, phish, scrape, overload, reverse engineer, or interfere with any system;
• attempt to bypass safety, billing, rate-limit, authentication, entitlement, or access controls;
• use Kuni to generate instructions for self-harm, harm to others, illegal activity, or abuse; or
• resell, sublicense, or commercially exploit Kuni without written permission.

10. Privacy

The Privacy Policy explains what information Kuni collects, how it is used, when it is shared, and the choices you may have. By using Kuni, you also agree to the Privacy Policy.

11. Service Changes, Availability, and Beta Features

Kuni may add, modify, pause, limit, or discontinue features at any time. Some features may be experimental, capacity-limited, connector-dependent, provider-dependent, or available only to certain users or plans. The Service may be interrupted, delayed, unavailable, or inaccurate.

12. Suspension and Termination

Kuni may suspend or terminate access if it reasonably believes you violated these Terms, created risk for another user or the Service, failed to pay required fees, abused messaging or connector systems, or used the Service in a way that could expose Kuni, its users, or its providers to legal, security, billing, or operational risk. You may stop using Kuni at any time, and you may request account deletion as described in the Privacy Policy.

13. Disclaimer of Warranties

To the maximum extent permitted by law, Kuni is provided "as is" and "as available." We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, uninterrupted operation, and error-free operation.

14. Limitation of Liability

To the maximum extent permitted by law, Kuni and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages; lost profits; lost data; personal injury; business interruption; substitute services; or damages arising from reliance on AI-generated outputs. To the maximum extent permitted by law, total liability for any claim relating to the Service will not exceed the greater of the amount you paid to Kuni in the three months before the event giving rise to the claim or CAD $100. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

15. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Kuni, its owners, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from your User Content, your use or misuse of the Service, your violation of these Terms, or your violation of law or another person's rights.

16. Governing Law and Disputes

Except where prohibited by law, these Terms and any dispute relating to Kuni are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Except where prohibited by law, disputes will be brought in the courts located in Ontario, Canada, and you consent to those courts' jurisdiction and venue.

17. Changes to These Terms

Kuni may update these Terms from time to time. If changes are material, Kuni will provide reasonable notice through the Service, by text, by email, or by posting the updated Terms. Continued use after updated Terms take effect means you accept the updated Terms.
